RELEASE OF LIABILITY, WAIVER OF CLAIMS, & ASSUMPTION OF RISKS AGREEMENT

(the “Release Agreement”)

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT OR INJURY

PLEASE READ THIS CAREFULLY!

Program Provider: The Kerrisdale Community Centre Society and their directors, officers, employees, instructors, agents, representatives, independent contractors, subcontractors, suppliers, successors, and assigns (all of whom are referred to herein as the “Releasees”).

Agreement: I have registered or am registering to take a certain program or course provided by the Releasees online through video conference technology (the “Online Program”). My review of and agreement to this Release Agreement is a requirement to take the Online Program.

The Online Program will be hosted by an instructor by way of video technology. The participants in the Online Program will be able to see each other and will be able to see each others’ names unless I choose to block my name from appearing to the other participants. I must ensure that my video feed is free of any images that would be reasonably be inappropriate for persons under the age of 19 to view. Recording of any participants in the Online Program is prohibited. The Releasees or any of them may record the instructor as long as none of the participants are recorded. I agree to these terms.

Assumption of Risks: I am aware that participating in the Online Program involves risks, dangers and hazards including but not limited to: equipment failure; improper use of equipment; falls; slips and falls; impact or collision with objects or other persons; injury arising from incorrect form or movement; negligence of other participants; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN THE ONLINE PROGRAM. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, EMOTIONAL DISTRESS, DEATH, PROPERTY DAMAGE, AND LOSS RESULTING THEREFROM.

Release of Liability and Waiver of Claims: In consideration of the Releasees agreeing to my participation in the Online Program, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in the Online Program, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN THE ACTIVITIES REFERRED TO ABOVE;

In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in the Online Program, other than what is set forth in this Release Agreement.

I have read the Release Agreement above, and I agree to be bound by its terms.
